RELATING TO CONDOMINIUMS.

Repeals chapter 514A, Hawaii Revised Statutes, relating to condominium property regimes, and ensures that all condominiums in the State are governed under chapter 514B, Hawaii Revised Statutes, relating to condominiums. Effective July 1, 2059.

Status

RELATING TO TAXATION.

Proposed HD2: Requires retailers or vendors that are not located in the State and not required to pay or collect general excise or use tax for sales to send certain information to purchasers in the State. Requires retailers or vendors to submit an annual report to the department of taxation. Exempts retailers or vendors who voluntarily collect and pay use tax to the department of taxation to be exempt from this requirement. Prohibits the department of taxation from assessing fines, charging interest, or penalizing in any way an individual who receives notification and does not pay the use tax. Amends the definition of business under Hawaii's general excise tax law.

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST MAUI ALL NATURAL ALTERNATIVE, LLC.

Authorizes the issuance of special purpose revenue bonds to assist Maui All Natural Alternative, LLC with the development of a project to provide municipal sludge processing and renewable energy at the Wailuku-Kahului wastewater reclamation facility on Maui.

RELATING TO RENEWABLE ENERGY.

Replaces the current renewable energy technology systems tax credit with tax credits for solar or wind energy property and energy storage property and is applicable to taxable years beginning after 12/31/2017. Establishes a demonstration project for building energy efficiency designs within the Department of Transportation.

RELATING TO THE HOUSING CHOICE VOUCHER PROGRAM.

Prohibits any county from disqualifying a legal nonconforming dwelling unit from the Housing Choice Voucher Program if the unit meets zoning and building code requirements and other program standards such as health and safety standards.

RELATING TO AFFORDABLE HOUSING.

Directs the Hawaii Housing Finance and Development Corporation or any appropriate entity of the State to initiate negotiations to keep the units of the Front Street Apartments on the island of Maui affordable or to acquire the Front Street Apartments property. Appropriates funds.

RELATING TO PSYCHOLOGY.

Establishes licensure requirements for school psychologists to be administered by the board of psychology. Amends the composition of the board to include two school psychologists.

Status

PROPOSING AMENDMENTS TO ARTICLES VII AND X OF THE CONSTITUTION OF THE STATE OF HAWAII TO AUTHORIZE THE LEGISLATURE TO ESTABLISH A SURCHARGE ON RESIDENTIAL INVESTMENT PROPERTY AND VISITOR ACCOMMODATIONS TO INCREASE FUNDING FOR PUBLIC EDUCATION.

Proposes amendments to the Constitution of the State of Hawaii to advance the State's goal of providing a public education for the children of Hawaii by authorizing the legislature to establish, as provided by law, a surcharge on residential investment property and visitor accommodations.

RELATING TO EDUCATION FUNDING.

Establishes an education surcharge on residential investment properties and visitor accommodations for the purpose of funding public education. Effective July 1, 2050.

RELATING TO AQUATIC LIFE.

Requires DLNR to submit proposed legislation to the legislature by the 2019 regular session including a definition of "sustainable", a policy for sustainable collection practices of near shore aquatic life, limits on collection, and any additional resources required by the department. Prohibits issuance of new aquarium permits and transfer of existing aquarium permits.

Status

RELATING TO HIGHWAY SAFETY.

Establishes the Photo Red Light Imaging Detector Systems Program (Program). Authorizes counties to administer the Program. Requires proceeds of fines to be expended in the county from which they were collected for operation of the Program. Makes an appropriation. Establishes a Red Light Running Committee.
