A BILL FOR AN ACT

 

 

RELATING TO HONOKOHAU SMALL BOAT HARBOR.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§200-     Honokohau small boat harbor; transfer of duties.  (a)  The board may transfer its duties under sections 200-2 and 200-3 to operate, administer, manage, and maintain Honokohau small boat harbor to a:

     (1)  Community-based board of the county where the harbor is located;

     (2)  Public-private partnership; or

     (3)  Private organization.

     (b)  An entity that assumes duties pursuant to this section shall comply with this chapter and all other applicable laws.

     (c)  The board shall adopt rules, pursuant to chapter 91, necessary for the purposes of this section."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2017-2018 for the repair and maintenance expenses of Honokohau small boat harbor.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2017.
