A BILL FOR AN ACT

 

 

proposing an amendment to article III, section 14, of the Hawaii state Constitution.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article III, section 14, of the Constitution of the State of Hawaii to ensure that no bill shall become law if the bill has been altered or amended during the legislative process to such an extent that the bill no longer reflects its original purpose, unless the bill is approved by a two-thirds vote in both the house and senate.

     SECTION 2.  Article III, section 14, of the Constitution of the State of Hawaii is amended to read as follows:

"BILLS; ENACTMENT

     Section 14.  No law shall be passed except by bill.  No bill shall become law if it has been so altered or amended during its passage through either house that the bill no longer reflects its original purpose, unless the bill is approved by a two-thirds vote in both the house and senate.  Each law shall embrace but one subject, which shall be expressed in its title.  The enacting clause of each law shall be, "Be it enacted by the legislature of the State of Hawaii.""

     SECTION 3.  The question to be printed on the ballot shall be as follows:

     "Shall a bill be prohibited from becoming law if it has been so altered or amended during its passage through either house that the bill no longer reflects its original purpose, unless the bill is approved by a two-thirds vote in both the house and senate?"

     SECTION 4.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
