A BILL FOR AN ACT

 

 

relating to OCEAN waters.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§200-     Kailua Bay; slow-no-wake.  (a)  No person shall operate a vessel within the ocean waters of Kailua Bay on Oahu within seven hundred fifty feet of the shoreline at a speed in excess of slow-no-wake; provided that this prohibition shall not apply to any law enforcement officer or lifeguard acting within the scope of the officer's or lifeguard's official duties.

     (b)  For the purposes of this section, "slow-no-wake" means as slow as possible without losing steerage way and so as to make the least possible wake."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2017.
