A BILL FOR AN ACT

 

 

relating to unfunded liabilities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established within the department of budget and finance the unfunded liabilities task force to develop recommendations to address state and county unfunded liabilities, including the unfunded liabilities of the employee retirement system.  The department of budget and finance shall provide administrative support to the task force.

     (b)  The taskforce shall include:

     (1)  The Hawaii employees' retirement system administrator, or the administrator's designee, who shall serve as the chairperson of the task force;

     (2)  The director of finance;

     (3)  A member of the house of representatives selected by the speaker of the house of representatives;

     (4)  A member of the senate to be selected by the senate president;

     (5)  Four members representing the respective interests of the four counties who shall be selected by the mayor of the respective county;

     (6)  A representative of the Hawaii Government Employees Association who shall be invited to participate by the Hawaii employees' retirement system administrator;

     (7)  A representative of the United Public Workers AFSCME Local 646 AFL-CIO who shall be invited to participate by the Hawaii employees' retirement system administrator;

     (8)  A representative of the Honolulu fire department to be selected by the mayor of the city and county of Honolulu; and

     (9)  Any additional members as determined by the task force.

     (c)  The task force, at a minimum, shall:

     (1)  Determine the best means for funding the respective liabilities;

     (2)  Consider relevant legislation, including legislation that:

          (A)  Addresses funding for the respective liabilities; and

          (B)  Requires consideration of the fiscal impact of new public sector positions on the respective liabilities; and

     (3)  Review policy recommendations from other states.

     (e)  Members of the task force shall serve without compensation, and all necessary expenses, including travel expenses, shall be paid by the agency, organization, or department to which the member belongs.  No member shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation as a member of the task force.

     (d)  The task force shall submit a report to the legislature of its findings, recommendations, and any proposed legislation, no later than twenty days prior to the convening of the regular session of 2017.

     (e)  The task force shall cease to exist on June 30, 2017.

     SECTION 2.  This Act shall take effect upon its approval.
