A BILL FOR AN ACT

 

 

RELATING TO THE KING KAMEHAMEHA CELEBRATION COMMISSION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 8-5, Hawaii Revised Statutes, is amended to read as follows:

     "§8-5  King Kamehameha celebration commission.  (a)  There shall be a commission to be known as the King Kamehameha celebration commission placed within the department of accounting and general services for administrative purposes.  The commission shall consist of thirteen members to be appointed by the governor in the manner provided by section 26-34.  The appointments shall be made from the following organizations, with at least one member from each organization:

     (1)  Royal Order of Kamehameha I;

     (2)  Ahahui Kaahumanu;

     (3)  Hale O Nā Alii O Hawaii Ahahui Poo;

     (4)  Daughters and Sons of Hawaiian Warriors[;]- Mamakakaua;

     (5)  Kamehameha Schools Alumni Association;

     (6)  Association of Hawaiian Civic Clubs;

     (7)  [Waimanalo Homesteaders Association;] Waimānalo Hawaiian Homes Association;

     (8)  [Kapahulu Music Club;] Daughters of Hawaii; and

     (9)  [Papakolea] Papakōlea Community Association.

Each organization shall maintain a certificate of good standing with the State of Hawaii issued by the department of commerce and consumer affairs and an active list of their members of the organization.  In selecting their respective member to the commission, the membership organizations may select members who will help provide administrative guidance to the commission with regards to legal, business, accounting, marketing, philanthropy, or public relations.  In addition, the governor shall appoint [one member from each of the following islands: Kauai, Maui, Molokai, and Hawaii.  Each of these members shall be a resident of the respective island that the member represents.] four at-large members representing the City and County of Honolulu and the counties of Kauai, Maui and Kalawao, and Hawaii.  The governor shall select members who will help provide administrative guidance to the commission with regard to legal, business, accounting, marketing, philanthropy, or public relations.

     (b)  The terms of all appointments shall be four years.  The governor shall appoint the chairperson of the commission from among the members.  The chairperson may appoint an advisory committee composed of past commission members and personnel to advise the chairperson on historical and archival background of the commission.

     (c)  The members of the King Kamehameha celebration commission shall serve without compensation, but shall be entitled to reimbursement for travel and necessary expenses while attending meetings and while in discharge of their duties.  The comptroller shall reimburse the members of the King Kamehameha celebration commission for all necessary expenses incurred during the discharge of their duties.

     (d)  [The commission may appoint and dismiss an arts program specialist and a part-time clerk typist, without regard to chapter 76, who shall serve at the commission's pleasure, and whose salaries shall be provided through fees, public contributions, and private donations.] The commission, by a majority vote, shall appoint an executive director, who shall:

     (1)  Serve without regard to chapter 76 for a term to be determined by the commission;

     (2)  Serve as the commission's chief executive officer;

     (3)  Be responsible for all fiscal and administrative matters, including securing public contributions, and private foundation grants and donations;

     (4)  Be responsible for developing and administering the programs under the commission's direction; and

     (5)  Be familiar with the people and culture of Hawaii.

The salary of the executive director shall be established by the commission; provided that such salary for the executive director shall not exceed the salary of department heads or executive officers.  The commission, by a two-thirds vote of all members to which it is entitled, may remove the executive director for cause at any time.  The commission may appoint and dismiss a part-time clerk typist, without regard to chapter 76, who shall serve at the commission's pleasure and whose salary shall be established by the commission.

     (e)  The commission shall have charge of all arrangements for the celebration under the direction of the commission and shall support other events as approved by the commission, each year generally observed throughout Hawaii Nei on June 11, to commemorate the memory of the great Polynesian Hawaiian warrior and statesman King Kamehameha I, who united the Hawaiian Islands into the Kingdom of Hawaii, and is recognized as such under section 8-1.  The commission may appoint committees and delegate powers and duties to the committees as it shall determine.

     (f)  The comptroller shall account for all moneys appropriated by the legislature, may raise funds to defray administrative costs, and may accept donations of money and personal property on behalf of the commission; provided that all donations accepted from private sources shall be expended in the manner prescribed by the contributor, and all moneys received from all sources shall be deposited into the commission's trust account.

     (g)  The commission shall be the coordinating agency for all state sponsored [as well as other celebration] events, as set forth in subsection (e) and [staged during the celebration period] as designated by the commission, to [assure] ensure activities planned are timely and appropriate to commemorate the memory of King Kamehameha I.  The commission is authorized to determine to whom and for which occasions permission is to be granted for the use of the statue of King Kamehameha I.

     (h)  The commission shall adopt rules pursuant to chapter 91 necessary for the purpose of this section."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act, upon its approval, shall take effect on July 1, 2016.
