A BILL FOR AN ACT

 

 

RELATING TO ETHICS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 84, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§84-    Exemption.  School employees shall be exempt from compliance with sections 84-11, 84-11.5, 84-13, 84-14(a)(2), and 84-14(d).

     (b)  As used in this section, "school employee" means a teacher, counselor, administrator, coach, or other employee employed by the department of education or a public charter school who plans, organizes, or serves as a chaperone on a non-publicly funded student educational trip and:

     (1)  Uses school facilities, school time, or school office supplies to organize, fund raise, or promote trips; or

     (2)  Receives a travel benefit, incentive, or gift from a tour or travel company that is to be used in conjunction with the same educational trip on which the employee serves as a chaperone, or plans or organizes."

     SECTION 2.  Any existing policy, procedure, or rule previously adopted by the department of education and state public charter school commission shall be reviewed for consistency and compliance with this Act within ninety days of the effective date of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on March 15, 2037.
