A BILL FOR AN ACT

 

 

relating to public utilities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 269, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§269-     Preferential rates for residents within one mile of a wind energy facility.  (a)  The public utilities commission shall establish preferential rates for consumers of energy who live within       mile of a wind energy facility and who are subject to any adverse impacts created by the wind-energy facility.

     (b)  The public utilities commission shall adopt rules in accordance with chapter 91 to:

     (1)  Establish preferential rates for any public utility service; and

     (2)  Determine which consumers of energy are subject to adverse impacts,

pursuant to this section.

     (c)  For purposes of this section, "wind energy facility" shall have the same meaning as defined in section 201N-31."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
