A BILL FOR AN ACT

 

 

RELATING TO CONSUMER PROTECTION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1. Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"453-   Prescription of narcotic drugs. Notwithstanding any other law to the contrary, no person licensed pursuant to this chapter shall:

(1) Prescribe more than three thirty-day sequential prescriptions authorizing the patient to receive a total of up to a ninety-day supply of a narcotic drug included in schedule II of title 21 United States Code section 812; or

(2) Authorize a prescription refill for a narcotic drug included in schedule III of title 21 United States Code section 812 more than five times."

SECTION 2. Chapter 463E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"463E-   Prescription of narcotic drugs. Notwithstanding any other law to the contrary, no person licensed pursuant to this chapter shall:

(1) Prescribe more than three thirty-day sequential prescriptions authorizing the patient to receive a total of up to a ninety-day supply of a narcotic drug included in schedule II of title 21 United States Code section 812; or

(2) Authorize a prescription refill for a narcotic drug included in schedule III of title 21 United States Code section 812 more than five times."

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2112.

Description:

Prohibits doctors and podiatrists from prescribing more than three sequential thirty-day prescriptions totaling a ninety-day supply of a schedule II controlled substance. Prohibits refills of a schedule III controlled substance more than five times. (HB1176 HD2)
