THE FOLLOWING MEASURES WERE PREVIOUSLY HEARD IN THEIR RESPECTIVE STANDING COMMITTEES:
PROPOSING A CONSTITUTIONAL AMENDMENT TO ARTICLE X, SECTION 6, OF THE HAWAII STATE CONSTITUTION TO MODIFY THE APPOINTMENT PROCESS FOR THE BOARD OF REGENTS OF THE UNIVERSITY OF HAWAII. Proposes an amendment to article X, section 6, of the Hawaii state constitution to modify the appointment process for the board of regents of the University of Hawaii. Repeals the requirement that appointments to the University of Hawaii board of regents be made from pools of qualified candidates presented to the governor by the candidate advisory council for the board of regents of the University of Hawaii.

RELATING TO EMPLOYMENT AGREEMENTS. Prohibits noncompete agreements and restrictive covenants that restrict beyond one year post-employment competition of employees of a technology business. (SD1)

RELATING TO OPERATING A VEHICLE WHILE INTOXICATED. Allows law enforcement officers to cause to be towed a motor vehicle if the operator is arrested or cited for various alcohol-related traffic offenses. Adds an exception for community caretaking. Provides definition of "community caretaking". (SD1)

RELATING TO USE OF INTOXICANTS WHILE OPERATING A VEHICLE. Allows an ignition interlock permit holder to take necessary tests to apply for relicensing during the final 30 days of the revocation period. Prohibits operating a vehicle with an ignition interlock permit without a state identification card. Prohibits operating a vehicle once a notice of administrative record has expired unless the driver has a valid driver's license.

RELATING TO PUBLIC SAFETY. Establishes an additional sanction available to the judiciary prior to full parole revocation. (SD1)

RELATING TO HEALTH. Prohibits possession or consumption of tobacco products, including electronic smoking devices, by any person under eighteen years of age in public places. Effective 07/01/2050. (SD1)

RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT. Updates chapter 329, Hawaii Revised Statutes, to make it consistent with amendments in federal law on controlled substances; amends section 329-20, HRS, to add new controlled substances federally scheduled as required under section 329-11, HRS; adds a new synthetic cathinone and eight new synthetic cannabinoids to section 329-14, HRS. RELATING TO VETERANS DISABILITY BENEFITS. Exempts federal veterans disability benefits from claims of creditors and attachment, levy, and seizure to enforce a court judgment, except for certain child and spousal support cases. (SD1)

RELATING TO WORKERS' COMPENSATION. Provides that an independent medical examination and permanent impairment rating examination shall be conducted by a qualified physician selected by the mutual agreement of the parties. Provides a process for appointment in the event that there is no mutual agreement. (SD1)

RELATING TO POST-SECONDARY EDUCATION. Clarifies that under the Hawaii Post-Secondary Education Authorization Program, institutions may request an administrative hearing pursuant to chapter 91, HRS, for proceedings concerning denials, suspensions, or terminations.
