RELATING TO THE CIVIL MONETARY PENALTY SPECIAL FUND.

A special fund is needed to deposit moneys from federal fines assessed against skilled nursing facilities and home health agencies during inspections conducted by the Department of Health on behalf of the U.S. Centers for Medicare and Medicaid Services.  These moneys cannot be comingled with any other federal or state funds.

Status

RELATING TO WATER INFRASTRUCTURE.

Establishes the authority to transfer federal capitalization grant funds between the Water Pollution Control Revolving Fund and the Drinking Water Treatment Revolving Loan Fund within the Department of Health, in accordance with the existing federal Safe Drinking Water Act, and as codified in Title 40 Code of Federal Regulations section 35.3530(c).  Effective July 1, 2015.

RELATING TO AMENDING IDENTITY OF REGISTRANT'S PARENT ON A BIRTH CERTIFICATE.

Clarifies that amendments to birth records that change parenthood shall not be conducted through the Uniform Information Practices Act procedures to correct personal records, but must be pursuant to a court order of appropriate jurisdiction or other legal establishment of parenthood.

RELATING TO CERTIFICATES OF BIRTH.

Establishes the documentation required when requesting the Department of Health to issue a new birth certificate with a gender designation change.  Establishes birth registrant's cause of action to petition for new certificate when Department refuses to issue a new certificate.

RELATING TO THE REGULATION OF TOBACCO PRODUCTS.

Amends chapter 328J, Hawaii Revised Statutes, to prohibit the use of electronic smoking devices in the places where smoking is prohibited and updates signage requirements.

RELATING TO HEALTH.

Increases the age in which one can sell, furnish, distribute or purchase tobacco or electronic smoking devices from 18 to 21.
