RELATING TO RENEWABLE STANDARDS.

Defines "large self-generator".  Increases renewable portfolio standards to 70 per cent by 12/31/2035 and 100 per cent by 12/31/2040, unless the acquisition of renewable energy is not beneficial to Hawaii's economy.  Establishes renewable standards for large self-generators.  Subjects large self-generators to applicable renewable standards.  Clarifies and establishes events or circumstances that are outside of an electric company's or large self-generator's reasonable control.  Establishes large self-generator reporting requirements to the public utilities commission.  Requires the public utilities commission to report on cost-effectiveness of renewable portfolio standards to address the impact on renewable energy developer energy prices.

RELATING TO RENEWABLE ENERGY.

Requires the department of taxation, in collaboration with the department of business, economic development, and tourism, to submit a joint report to the legislature each year that is related to tax credits for renewable energy technology properties, the total cost of the renewable energy tax credits to the State, and the estimated economic benefit of the renewable energy tax credits for each of the previous four taxable years.  Appropriates funds to the respective departments for necessary costs in preparing and submitting the joint report.

RELATING TO GENERAL EXCISE TAX.

Provides a general excise tax exemption on gross proceeds received from the construction, sale, installation, service, repair, modification, improvement, or lease of clean alternative fuel vehicles, electric vehicle batteries, and electrical vehicle infrastructure.  Repeals January 1, 2019.

Prohibits the public utilities commission from approving power purchase agreements that prohibit the sale of energy to third parties or require utility consent to sell energy to third parties.

Expands the types of energy generation and distribution devices that could make certain electric utility customers eligible for net energy metering.  Defines renewable energy generation and distribution device.

Requires separate electricity utility metering of nonresidential and residential condominium units in all condominium projects.

Appropriates funds as a grant to the Pacific-Asia institute for resilience and sustainability to continue in its collaborative research efforts in exploring methods to improve energy efficiency and grid operations in all of Hawai‘i.

Permits the installation of clotheslines in any residential dwelling, apartment, condominium, or townhouse, under certain conditions.  Defines a reasonable restriction on the placement and use of clotheslines as any restriction that is necessary to protect public health and safety, buildings from damage, historic or aesthetic values, and shorelines under certain circumstances.

RELATING TO TAXATION.

Amends session law to repeal the sunset provision relating to the tax on naphtha fuel sold for use in a power generating facility, thereby making the amendments made by Act 103, Session Laws of Hawaii 2007, permanent.

      Status & Testimony

RELATING TO TAXATION.

Establishes a renewable fuels production tax credit and repeals the ethanol facility tax credit.  Allows qualifying taxpayers to claim a refundable income tax credit equal to 20 cents per seventy six thousand British thermal units of renewable fuel, capped at $3,000,000 per year for up to five years.  Caps the credit at $12,000,000 per year in aggregate.  Requires the department of business, economic development, and tourism to certify all tax credits and submit a report regarding the production and sale of renewable fuels to the governor and legislature each year.  Directs the department of taxation to create forms for the tax credit.  Applies to taxable years beginning after December 31, 2015.

RELATING TO ETHANOL.

Repeals existing requirement that gasoline for motor vehicles be composed of 10 per cent ethanol.
