A BILL FOR AN ACT

 

 

relating to the department of land and natural resources.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 171, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"PART    .  PUBLIC RESTROOM MAINTENANCE

     §171-A  Public restroom maintenance system.  (a)  The department shall implement a public restroom maintenance system that includes restrooms located in areas under the jurisdiction of the department, including:

     (1)  Every park and all park reserves in the state parks system;

     (2)  Small boat harbors and other areas managed by the division of boating and ocean recreation;

     (3)  Areas managed by the division of forestry and wildlife, including remote areas with composting toilets within areas managed by the department; and

     (4)  Any other areas with public restrooms managed by the department.

     (b)  The public restroom maintenance system shall ensure that every public restroom within the system is inspected at least once every day to ensure that:

     (1)  Toilets and showers are clean and operative;

     (2)  Sink faucets are operative;

     (3)  Soap is available at or near the sinks;

     (4)  Floors are clean;

     (5)  Trash receptacles are not stuffed or overflowing; provided that volunteers may empty the trash daily under the authority of the department;

     (6)  Every public restroom has at least one trash receptacle located near the entrance to the restroom; and

     (7)  An adequate supply of toilet paper is available for each toilet.

The department may modify the requirements of this subsection for public restrooms located in remote areas, such as the back woods, that may have composting toilets or otherwise lack standard restroom equipment; provided that such facilities are physically inspected at least one a month.

     (c)  The department shall keep adequate maintenance records of each item enumerated under subsection (b).

     §171-B  Public restrooms asset management system.  (a)  To protect the capital improvement investment of the State and in the interests of public health and safety, the department shall establish an asset management system for public restrooms included in the public restroom maintenance system pursuant to section 171-A.  The asset management system shall document and manage the following information:

     (1)  Daily inspection reports of each restroom; provided that public restrooms located in remote areas that may have composting toilets may have inspection reports less frequently than daily, but not less than monthly;

     (2)  An ongoing assessment of the repair status of each public restroom;

     (3)  An inventory and schedule of needed short-term and long-term restroom repairs, including information on what can be done with existing resources and what additional resources are needed to fully complete repair to every public restroom;

     (4)  An estimate of the cost of repairs described under paragraph (3) as well as a timetable of completing the repairs;

     (5)  An estimate of the remaining life span of each restroom; and

     (6)  A description and estimated cost of infrastructure improvements, including water and wastewater lines for each restroom.

     (b)  The department shall report to the legislature no later than twenty days prior to the regular session of 2016 and every third regular session thereafter on the status and modifications to the public restrooms asset management system."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $5,000,000 or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for establishment and maintenance of the public restroom maintenance system pursuant to section 1 of this Act.

     The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 4.  This Act shall take effect on July 1, 2015.
