A BILL FOR AN ACT

 

 

RELATING TO THE HAWAII STATE BUILDING CODES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the state building code council was created in 2007 to review and adopt current, nationally recognized building codes and standards for Hawaii.  The council is required to review and adopt, as appropriate, new model building codes within eighteen months of the official publication date of various codes and standards, including the International Building Code, which establishes minimum regulations for building systems and is promulgated every three years.  However, Hawaii, unlike at least twenty other states, has not adopted the current regulations established and promulgated in the 2012 International Building Code publication.  The failure to adopt current International Building Code regulations poses a serious safety issue for Hawaii's residents, due to the State's unique geographic location and vulnerability related to natural disasters.

     SECTION 2.  Section 107-28, Hawaii Revised Statutes, is amended to read as follows:

     "§107-28  County authority to amend and adopt the Hawaii state building codes or recent codes and standards without council approval.  (a)  The governing body of each county shall amend, adopt, and update the Hawaii state building codes as they apply within their respective jurisdiction, in accordance with section 46-1.5(13), without approval of the council.  Each county shall amend and adopt the Hawaii state building codes and standards listed in section 107-25, as the referenced Hawaii state building codes and standards for its respective county building code ordinance, no later than two years after the adoption of the Hawaii state building codes.

     (b)  If a county does not amend the Hawaii state building codes within the two-year time frame, the Hawaii state building codes shall become applicable as an interim county building code.

     (c)  If the council fails to update and adopt the Hawaii state building codes as required in section 107-24, the governing body of each county may review and adopt, as appropriate, the more current codes and standards identified in section 107-25; provided that the codes and standards are not in conflict with chapters 444 and 464."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
