A BILL FOR AN ACT

 

 

RELATING TO METHAMPHETAMINE TRAFFICKING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 712-1240.7, Hawaii Revised Statutes, is amended by amending subsection (1) to read as follows:

     "(1)  A person commits the offense of methamphetamine trafficking in the first degree if the person knowingly:

     (a)  Possesses one or more preparations, compounds, mixtures, or substances of an aggregate weight of one ounce or more containing methamphetamine or any of its salts, isomers, and salts of isomers;

     (b)  Distributes one or more preparations, compounds, mixtures, or substances of an aggregate weight of [one‑eighth] one-half ounce or more containing methamphetamine or any of its salts, isomers, and salts of isomers;

     (c)  Distributes methamphetamine in any amount to a minor; or

     (d)  Manufactures methamphetamine in any amount."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
