Status

RELATING TO PUBLIC WORKS.

Establishes the Wage and Hour for Public Works Projects Special Fund and establishes and funds two additional labor law enforcement specialist IV positions to assist the enforcement of Hawaii's wage and hour law on public construction projects.  Specifies a funding mechanism for the special fund and requires an annual report.  Exempts the Department of Transportation's Airports Division from the special fund fee.  Effective July 1, 2014.

Status

RELATING TO WAGES AND HOURS ON PUBLIC WORKS LAW CONTRACTOR COMPLIANCE.

Increases the prevailing wage penalty from $1,000 per project and $100 per day to $10,000 per project and $1,000 per day.  Clarifies that general contractors are secondarily liable for wages and penalties found due by their subcontractors and their agents.  Prohibits private agreements made to contravene the law.  Adds a definition for "contractor" and "public work".

MAKING AN APPROPRIATION TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND.

Makes a general fund appropriation of $         for fiscal year 2014-2015 for deposit into the Hawaii Employer-Union Health Benefits Trust Fund.

Status

RELATING TO WORKERS' COMPENSATION.

Imposes a penalty on an employer who does not pay an employee temporary partial disability benefits within fourteen calendar days after the end of the employee's customary work week.  Clarifies that an eligibility determination for disability benefits depends on the employee's entire record and the failure of the attending physician to certify a specialized form provided by the employer or the department does not disqualify the employee from disability benefits.

RELATING TO FIREFIGHTERS.

Provides firefighters with comprehensive medical coverage through workers compensation law and service connected disability retirement benefits through a presumptive law for cancer, blood-borne infectious diseases, and exposure to a biochemical substance.  Effective July 1, 2014.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website after the hearing adjourns.  This public posting of testimony on the website should be considered when including personal information in your testimony.
