Status

RELATING TO WORKERS' COMPENSATION.

Requires independent medical examinations and permanent impairment rating examinations for workers' compensation claims to be performed by physicians mutually agreed upon by employers and employees.  Allows for the use of an out-of-state physician under certain conditions.  Repeals on 06/30/2018.

Status

RELATING TO WORKERS' COMPENSATION MEDICAL FEE SCHEDULE.

Requires DLIR to update the workers' compensation medical fee schedule annually.  Authorizes DLIR to establish a workers' compensation medical fee ceiling that exceeds 110% of the fees prescribed in the Medicare Resource Relative Value Scale for Hawaii.  Effective 07/01/14.  Sunsets 06/30/19.

Status

RELATING TO CRIMINAL HISTORY RECORD CHECKS FOR STATE AND COUNTY EMPLOYEES.

Allows the State and counties to perform criminal history record checks on employees, prospective employees, volunteers, and contractors whose positions allow them access to sensitive information, firearms, and secured areas and on employees, prospective employees, volunteers, and contractors whose positions require them to work with county community-based programs for children.

Status

RELATING TO HUMAN TRAFFICKING.

Establishes the human trafficking victim services fund to be administered by the department of labor and industrial relations to provide support and services to human trafficking victims.

Status

RELATING TO EMPLOYMENT.

Requires twelve weeks of partially-paid leave at a maximum of sixty-six per cent of regular salary for all employees.  Establishes trust fund funded by employee contributions.  Appropriates funds to the Department of Labor and Industrial Relations for positions to administer the trust fund.  Effective July 1, 2014.

Status

RELATING TO WAGE AND HOUR LAW.

Increases from $2,000 to $3,000 the amount of guaranteed monthly compensation required to exempt an individual from minimum wage, overtime, and record keeping requirements under the Hawaii Wage and Hour Law.

Status

RELATING TO WORKFORCE DEVELOPMENT.

Establishes the office of talent management within DHRD to design and facilitate state initiatives in the areas of talent administration, professional development, performance management, and leadership enterprise.  Authorizes the talent management administrator to receive from any state agency the assistance, services, facilities, and data the administrator deems necessary to carry out the duties of the office.  Effective 07/01/2014.

Status

RELATING TO EDUCATION.

Requires the director of labor and industrial relations to convene a task force to examine the feasibility of establishing a pay forward, pay back program at UH.  Makes an appropriation.  Effective 07/01/2014.

Status

RELATING TO PAYMENT OF WAGES.

Clarifies that employers may pay wages by direct deposit under certain conditions.  Prohibits employers from paying wages by pay cards, debit cards, or similar means of electronic payment card.  Makes employers responsible for any fees incurred if an employer has insufficient funds for the direct deposit.
