RELATING TO OFFENSES OF SEXUAL ASSAULT.

Amends the elements required to establish:  (1) sexual assault in the first, second, and third degrees with regard to subjecting another person to sexual penetration by compulsion, and (2) sexual assault in the third degree with regard to sexual contact by compulsion.

RELATING TO HIGHWAY SAFETY.

Specifies that operating a motor vehicle in the State while using a mobile device is a traffic infraction.  Specifies that the penalty for such an infraction shall be a fine of not less than $250 and that collected fines shall be deposited in the state highway fund.  (HB1509 HD1)

Status

RELATING TO ABUSE OF FAMILY OR HOUSEHOLD MEMBER.

Extends the period of separation that a police officer can order under suspicion of physical abuse or harm to 4:30 p.m. on the second business day following the weekend or legal holiday if the forty-eight hour period of separation expires on any Saturday, Sunday, or legal holiday or if the incident occurs after 12:00 p.m. on any Friday, or on any Saturday, Sunday, or legal holiday.

RELATING TO JUVENILE JUSTICE INFORMATION.

Allows the dissemination of information from the juvenile justice information system to law enforcement agencies for purposes of the administration of law enforcement and law enforcement agency employment.

RELATING TO THE UNIFORM MEDIATION ACT.

Clarifies the scope of the Uniform Mediation Act.

RELATING TO UNLICENSED CONTRACTOR FRAUD.

Clarifies the offense of unlicensed contractor fraud by specifying that the "intent to deprive" may be formed before or after the person obtains or exerts control over the property of another.

RELATING TO GOVERNMENTAL ACCESS TO STORED COMMUNICATIONS.

Requires law enforcement to obtain:  (1) a search warrant to compel production of the contents of electronic communications; and (2) a court order to compel production of historical transactional records.

Status

RELATING TO ELECTIONS.

Requires the chief election officer to select a letter of the alphabet by lot and arrange candidate names on ballots in alphabetical order by last name, beginning with the randomly selected letter.  Applies to elections in the next two year election cycle following effective date.

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.  Those wishing to provide oral testimony will be limited to two minutes.
