A BILL FOR AN ACT

 

 

relating to juveniles.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 571-21, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  In cases of violation of a law or ordinance by a child, the issuance of a citation or summons, when provided for by law or ordinance, shall be sufficient to invoke the jurisdiction of the court, which may proceed to dispose of such a case with or without preliminary investigation and the filing of a petition.

     The court may dispose of the case by referring the child to a restorative justice program when the court deems it would be in the best interest of the child and the child admits guilt."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
