A BILL FOR AN ACT

 

 

relating to TRAINING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 92F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§92F-    Mandatory training on public agency meetings and information practices; boards and commissions.  (a)  All members of boards, commissions, or committees subject to section 26-34 shall complete a public agency meetings and information practices training course administered by the office of information practices within six months of a member being confirmed by the senate pursuant to section 26-34.

     (b)  The office of information practices shall establish, design, supervise, and conduct public agency meetings and information practices training designed specifically for members of boards, commissions, and committees.  The training course shall include:

     (1)  Explanations and discussions of the laws under this chapter and chapter 92, rules, advisory opinions, and relevant internal policies;

     (2)  Specific technical and legal requirements;

     (3)  The underlying purposes and principles of the laws under this chapter and chapter 92;

     (4)  Examples of practical application of the laws and principles; and

     (5)  A question-and-answer participatory segment regarding common problems and situations.

The office of information practices shall develop the methods and prepare any materials necessary to implement the course.

     (c)  The office of information practices shall designate those of its legal staff to conduct the public agency meetings and information practices training course and notify each member of a board, commission, or committee that attendance is mandatory.

     (d)  The public agency meetings and information practices training course shall be held in January and July of each year.  The course shall last at least two hours.  The office of information practices may repeat the course as necessary to accommodate all persons who are required to attend.

     (e)  Each state agency shall timely provide the office of information practices the names of those required to take the course and assist the office by providing adequate meeting facilities for the training course.

     (f)  For purposes of this section, "public agency meetings and information practices training" means education and training in:

     (1)  The public agency meetings and records laws set forth in chapter 92; and

     (2)  The information practices laws set forth in this chapter."

     SECTION 2.  Section 84-41, Hawaii Revised Statutes, is amended to read as follows:

     "§84-41  Applicability of part.  This part applies to legislators, members of the board of education, trustees of the office of Hawaiian affairs, the governor, the lieutenant governor, [and] executive department heads and deputies[.], and members of boards, commissions, and committees subject to section 26-34.  This part does not apply to any other officer or employee of the State."

     SECTION 3.  Section 84-42, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§84-42[]]  Mandatory ethics training course.  All state officers and employees enumerated in section 84-41 shall complete an ethics training course administered by the state ethics commission as provided in this part[.]; provided that a member of a board, commission, or committee shall complete an ethics training course within six months of the member being confirmed by the senate pursuant to section 26-34.  For the purposes of this part, "ethics training" includes education and training in:

     (1)  The ethics laws set forth in this chapter; and

     (2)  The lobbying laws set forth in chapter 97."

     SECTION 4.  Section 84-43, Hawaii Revised Statutes, is amended by amending subsection (d) to read as follows:

     "(d)  [The ethics] Ethics training [course] courses shall be held in January and July of each year for those who have not attended the course previously.  The course shall last at least two hours in length."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect upon its approval.
