HOUSE CONCURRENT

RESOLUTION

 

 

establishing annual registration and safety inspection requirements for mopeds throughout the state.

 

 

 


     WHEREAS, the rising price of gasoline has contributed to the increasing number of persons riding mopeds as mopeds are a less costly alternative to driving an automobile; and

 

     WHEREAS, the City and County of Honolulu reports that in every year since 2006, the number of registered mopeds in the State of Hawaii has increased, and there are now over 30,000 registered mopeds; and

 

     WHEREAS, moped users include youths ages 15 years and older, as well as out-of-state tourists who rent mopeds for leisure without the assurance that the moped has been deemed to be in a safe operating condition; and

 

     WHEREAS, the City and County of Honolulu's report of approximately 354 moped-related accidents in 2012, with an average of five fatalities per year since 2003, has resulted in growing concern for the safety of all moped users in Hawaii; and

 

     WHEREAS, the Director of Transportation is required to establish criteria and procedures for the annual safety inspection of every moped under section 291C-202(c), Hawaii Revised Statutes, but mandatory safety inspections have been implemented only in the Counties of Maui and Hawaii; and

 

     WHEREAS, duties applicable to drivers of motor vehicles are extended to persons driving mopeds under section 291C-193, Hawaii Revised Statutes; now, therefore,

     BE IT RESOLVED by the House of Representatives of the Twenty-seventh Legislature of the State of Hawaii, Regular Session of 2014, the Senate concurring, that annual registration and safety inspection requirements be established for mopeds throughout the State; and

 

     BE IT FURTHER RESOLVED that the Director of Customer Services of the City and County of Honolulu and Director of Transportation of the County of Kauai are requested to establish annual registration and safety inspection requirements for all mopeds as defined under section 291C-1, Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that the Director of Transportation is requested to establish criteria and procedures for annual safety inspections of mopeds, as required under section 291C-202, Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation, Director of Customer Services of the City and County of Honolulu, and the Director of Finance of the County of Kauai.
