A BILL FOR AN ACT

 

 

RELATING TO DENTISTRY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 448, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§448-    General anesthesia; intravenous-conscious sedation; conscious sedation; written authorization required.  (a)  Any person who practices dentistry or dental surgery in this State and who prescribes or administers general anesthesia, intravenous-conscious sedation, or conscious sedation shall meet the licensure and other requirements of this chapter and shall possess written authorization to administer general anesthesia, intravenous-conscious sedation, or conscious sedation as applicable, issued by the board.

     (b)  Any dentist who prescribes or administers general anesthesia, intravenous-conscious sedation, or conscious sedation shall do so in accordance with rules adopted by the board.

     (c)  Any place of practice of any licensed dentist and any dental facility where general anesthesia, intravenous-conscious sedation, or conscious sedation are prescribed or administered shall possess a site certificate issued by the board and shall comply with the standards for site certificates as established by the board.

     (d)  The board shall adopt rules pursuant to chapter 91 to implement this section and shall include criteria specifying the requirements, conditions, and standards for which written authorizations to administer general anesthesia, intravenous-conscious sedation, and conscious sedation and for site certificates are issued, renewed, and revoked."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Requires any dentist who prescribes or administers general anesthesia, intravenous-conscious sedation, or conscious sedation in providing dental services to obtain a written authorization issued by the Board of Dental Examiners.  Requires site certification for locations where specified anesthesia is prescribed or administered.
