A BILL FOR AN ACT

 

 

RELATING TO PUBLIC SAFETY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State requires a plan to relocate public safety services located within and nearby inundation zones to a centralized non-inundation zone area that will provide direct access to highways and be in convenient proximity to hospital and military services and assistance.  In the event of a major disaster, critical systems could be unavailable for months, negatively impacting the lives of many tens of thousands of citizens and costing the State tens of millions of dollars in unplanned system recovery and restart costs.

     The legislature further finds that the State's current data center environment is not fulfilling the capacity, reliability, and security needs of the various departments.  The existence of more than thirty low-quality data centers, which are poorly secured and monitored and completely unmanned more than sixty-five per cent of the time, exposes the State to the possibility of significant physical and cyber security breaches, resulting in the loss of confidential information about our most vulnerable citizens.  Compromising citizens' security and damaging the reputation of the State as a trustworthy data custodian could expose the State to tens of millions of dollars in liability and remediation costs.

     The legislature further finds that the high technology development corporation in collaboration with the department of accounting and general services and chief information officer, has the ability to oversee the design, construction, and operation of a data center that can house the State's centralized computing resources along with key staff that support and maintain these resources.

     The purpose of this Act is to centralize first responders and cyber security facilities to enable the sharing of resources and support services by establishing a central Oahu first responders technology campus and cyber security command center.

     SECTION 2.  Chapter 206M, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part    .  FIRST RESPONDERS technology campus and cyber security command center

     §206M-     First responders technology campus and cyber security command center; established.  There is established a central Oahu first responders technology campus and cyber security command center that shall include properties identified by the following tax map key numbers:  9-5-002-057; 9-5-046-010; 9-5-046-018; 9-5-046-041; and 9-5-046-042.  The first responders technology campus and cyber security command center shall be administered by the board.

     §206M-     Objective of the first responders technology campus and cyber security command center.  The objective of the first responders technology campus and cyber security command center shall be to centralize first responders and cyber security facilities to enable the sharing of resources and support services.

     §206M-     Guidelines.  (a)  The board shall work with the department of accounting and general services and the chief information officer to design and develop the first responders technology campus and cyber security command center.

     (b)  The chief information officer shall enter into memoranda of understanding with the following agencies:

     (1)  Department of defense; provided that the department is allocated       acres for facilities;

     (2)  Department of public safety; provided that the department is allocated       acres for facilities;

     (3)  State fire council; provided that the council is allocated       acres for facilities;

     (4)  City and county of Honolulu department of emergency management; provided that the department is allocated       acres for facilities;

     (5)  Honolulu police department; provided that the department is allocated       acres for facilities;

     (6)  Hawaii state civil defense; provided that the entity is allocated       acres for facilities;

     (7)  Hawaii national guard; provided that the entity is allocated       acres for facilities; and

     (8)  Other federal, state, and county agencies that may assist with the initiatives as determined by the chief information officer.

     (c)  Agencies and services shall enter into interagency agreements where efforts might be duplicated.

     (d)  The first responders technology campus and cyber security command center shall include:

     (1)        acres for a data center that is located on a site that is away from flood and tsunami hazard zones and is supplied with reliable electric power and many diverse and redundant high speed telecommunications connections; provided that the data center is an energy efficient, green facility with a smaller environmental footprint than existing data centers; provided further that the data center include an eight-thousand-to-ten-thousand-square-foot computer room with two-hundred fifty racks, an electric power load of two megawatts total for information technology equipment, and a tier 3 reliability rating;

     (2)  Ten acres dedicated for an innovation and research facility;

     (3)  Forty acres dedicated for a sheriff facility that includes a headquarters building for administrative offices, conference rooms, and an emergency operations center and a training facility for classrooms, a gym, emergency vehicle operations course, mock crime scene facility, SWAT house for tactical training, and dormitories; and

     (4)        acres dedicated for a state fire council facility that includes a building dedicated to public safety training; warehouses for proper storage of vehicles, equipment, and supplies; fire training building; rappelling towerburn building; urban search and rescue sets; helicopter landing field and training area; driving course; wellness, fitness, and training areas; gymnasium; swimming and diving pool; athletic field; maintenance facilities; fuel depot; vehicle repair; and equipment repair.

     §206M-     Incentives.  The board shall develop appropriate incentives to develop a first responders technology campus and cyber security command center pursuant to this part.  The incentives may include:

     (1)  Issuance of special purpose revenue bonds pursuant to section 206M-9; and

     (2)  Issuance of special facility revenue bonds pursuant to part III.

     §206M-     Emergency and cyber security services; relocation.  Emergency and cyber security services located in an inundation zone shall create a two-year transition plan that:

     (1)  Relocates emergency and cyber security services to the first responders technology campus and cyber security command center;

     (2)  Strengthens overall preparedness; and

     (3)  Installs building blocks for a more comprehensive emergency response in the future."

     SECTION 3.  Section 206M-2, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is established the high technology development corporation, which shall be a public body corporate and politic and an instrumentality and agency of the State.  The development corporation shall be placed within the department of business, economic development, and tourism for administrative purposes, pursuant to section 26-35.  The purpose of the development corporation shall be to facilitate the growth and development of the commercial high technology industry in Hawaii.  Its duties shall include, but not be limited to:

     (1)  Developing and encouraging industrial parks as high technology innovation centers and developing or assisting with the development of projects within or outside of industrial parks, including participating with the private sector in such development;

     (2)  Providing financial and other support and services to Hawaii-based high technology companies;

     (3)  Collecting and analyzing information on the state of commercial high technology activity in Hawaii;

     (4)  Promoting and marketing Hawaii as a site for commercial high technology activity; [and]

     (5)  Providing advice on policy and planning for technology-based economic development[.]; and

     (6)  Developing a first responders technology campus and cyber security command center pursuant to part      ."

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2014-2015 for the establishment of a central Oahu first responders technology campus and cyber security command center.

     The sum appropriated shall be expended by the high technology development corporation for the purposes of this Act.

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on January 20, 2050.
