RELATING TO THE GENERAL EXCISE TAX.

Repeals the general excise tax exemption for housing projects built on federal lands. Provides that tax revenues gained from repealing this exemption shall be deposited into the rental housing trust fund for the purpose of building affordable rental housing for homeless families with children.

RELATING TO GEOTHERMAL RESOURCES.

Repeals Act 97, SLH 2012, relating to geothermal resources which differentiates between "geothermal resources exploration" and "geothermal resources development". Designates "geothermal resources exploration" and "geothermal resources development" as permissible uses in all state land use districts and certain conservation district zones in accordance with chapter 205, HRS. Enacts geothermal resource subzones, designation of areas as geothermal resources subzones, and exploratory wells, which were repealed by Act 97. Effective July 1, 2025. (HB106 HD1)

RELATING TO MINERAL RESOURCES.

Promotes renewable energy in Hawaii by: (1) providing that all penalties, fees, and costs established and collected by the Department of Land and Natural Resources pursuant to Chapter 182, Hawaii Revised Statutes, be deposited in the Special Land and Development Fund; (2) including geothermal resources within the definition of a renewable energy producer; and (3) clarifying the permitting procedures for regulators and renewable energy developers considering geothermal development. RELATING TO LAND USE.

Provides that the absence in the Hawaii state plan of a priority guideline or functional plan applicable to a proposed reclassification of district boundaries shall not be grounds for the LUC to defer a decision on the petition to the applicable county pursuant to its county general plan. Eliminates LUC consideration of the impacts of certain areas of state concern.
