A BILL FOR AN ACT

 

 

RELATING TO DOCUMENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 27, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§27-    Acceptance of copies of documents permissible.  Notwithstanding any law or rule to the contrary, the State shall not require any person to file the original of any document for any purpose if a duplicate copy of the original is available for filing."

     SECTION 2.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Acceptance of copies of documents permissible.  Notwithstanding any law or rule to the contrary, a county shall not require any person to file the original of any document for any purpose if a duplicate copy of the original is available for filing."

     SECTION 3.  This Act, upon its approval, shall apply retroactively to any duplicate copy of an original document filed in lieu of an original document prior to the effective date of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
