A BILL FOR AN ACT

 

 

relating to waste reduction.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaii residents are regularly inundated with unsolicited telephone books, such as the yellow and white pages, and advertising materials that are left on their doors, doorsteps, or in their yards.

     Many of these items go unclaimed, causing litter and an unnecessary use of resources.  In addition, may of these items are not one hundred per cent recyclable.

     The purpose of this Act is to require that distributors of telephone directories and advertising materials pick up unclaimed telephone directories and advertising materials within seven days of receiving a request to do so if the telephone directories and advertising materials are not made out of one hundred per cent recyclable materials.

     SECTION 2.  Chapter 342H, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§342H-    Distribution of telephone directories; advertising materials.  (a)  A person, entity, or business that distributes any advertising material or telephone directory to any privately-owned residence or business shall pick up the unclaimed telephone directory or advertising materials within seven days of receiving a request to do so from any person residing at the household or representing the entity or business if the telephone directory or advertising materials are not made out of one hundred per cent recyclable materials.  All telephone directories and advertising materials shall contain a universal symbol that the telephone directory or advertising materials are made out of one hundred per cent recyclable materials, if applicable, and the distributor's contact information in clear and conspicuous print.

     (b)  Violators of this section shall be subject to a civil fine of $100, to be imposed by the director, for each telephone directory or advertising material distributed in violation.  Any person, household, entity, or business may report a violation to the department.

     (c)  As used in this section:

     "Advertising material" means any printed material, circular, leaflet, pamphlet, booklet, handbill, or other printed or reproduced material containing a written or pictorial message that is predominately and essentially an advertisement.

     "Distribute" means the delivery or giving to another, or leaving with another of a telephone directory.

     "Telephone directory" means a book in which are listed alphabetically the names of persons, businesses, and other entities having telephones in a specified area, along with their addresses and telephone numbers.  "Telephone directory" includes locality directories and the yellow pages.

     "Yellow pages" means a book or a section of a telephone directory listing businesses, services, or products alphabetically according to field.

     (d)  The department may adopt rules pursuant to chapter 91 to carry out the purpose of this section."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
