A BILL FOR AN ACT

 

 

Relating to antique gambling devices.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 712-1226, Hawaii Revised Statutes, is amended to read as follows:

     "§712-1226  Possession of a gambling device.  (1)  A person commits the offense of possession of a gambling device if the person manufactures, sells, transports, places, possesses, or conducts or negotiates any transaction affecting or designed to affect ownership, custody, or use of any gambling device, knowing it is to be used in the advancement of gambling activity [which] that is not social gambling.

     (2)  This section shall not apply to the possession of any antique slot machine not intended to be used in the advancement of gambling activity. 

     (3)  For the purposes of this section, "antique slot machine" means any gambling device that operates, either completely automatically or with the aid of some physical act by the player, as a result of the insertion of a coin or other object, and is twenty-five years or older from the date of manufacture.

     [(2)] (4)  Possession of a gambling device is a misdemeanor."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
