A BILL FOR AN ACT

 

 

Relating to indigenous peoples' day.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 8-1.5, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§8-1.5[]  Discoverers'] Indigenous Peoples' Day.  The second Monday in October shall be known as [Discoverers'] Indigenous Peoples' Day, in recognition of the:

     (1)  Polynesian discoverers of the Hawaiian Islands[, provided that this];

     (2)  Accomplishments of the indigenous voyagers who founded and settled the myriad islands of the Pacific Ocean more than one thousand years before Columbus was born; and

     (3)  Countless indigenous peoples who perished as a result of confrontations between indigenous peoples and Europeans.

This day shall serve as a day to educate the general public on the State of Hawaii's obligations to the Native peoples of Hawaii, including the State's continued protection of all rights customarily and traditionally exercised by the descendants of those Native peoples.  This day is not and shall not be construed to be a state holiday."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
