RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Corrects errors; harmonizes ordinary disability and ordinary death benefits for new members of the Employees' Retirement System with their service retirement benefits; and harmonizes age and service requirements for judges who are currently members of the Employees' Retirement System with the requirements for other contributory plan members.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Requires employers to pay greater contribution rates on their employees' non-base compensation than on base compensation beginning in fiscal year 2013-2014. Clarifies that deferred compensation deductions not be considered as non-base compensation. Makes it applicable to collective bargaining agreements reached after July 1, 2013, and not collective bargaining agreements currently in effect.

PROPOSING AN AMENDMENT TO ARTICLE VII, SECTION 6, OF THE HAWAII CONSTITUTION, RELATING TO THE DISPOSITION OF EXCESS REVENUES.

Proposes a constitutional amendment to article VII, section 6 of the state constitution to authorize the legislature to deposit excess general fund revenues into a fund to fund pension benefits and other post-employment benefits for State employees.

RELATING TO THE EMERGENCY AND BUDGET RESERVE FUND.

Increases from 5% to 30% the percentage of moneys from the excess general fund balance to be deposited into the emergency and budget reserve fund as a temporary source of funding during economic downturn. Requires 30% of the excess general fund balance to be used to reduce the unfunded liability of the EUTF.

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND.

Provides for the automatic deposit of general excise tax revenues into the Hawaii employer-union health benefits trust fund until such time that the trust fund's unfunded actuarial accrued liability is fully amortized. Effective July 1, 2013.

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND.

Requires the Department of Budget and Finance to conduct a study to reform the Hawaii employer-union health benefits trust fund. Requires the department to submit the study to the governor, legislature, and board of trustees of the trust fund before the convening of the 2014 regular session. Appropriates $100,000 in FY 2012-13 for the study.

Amends section 87A-1, Hawaii Revised Statutes, to add a new definition of "credited service" and to clarify the definitions of "employee" and "part-time, temporary, and seasonal or casual employee."

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND.

Requires, no later than January 1, 2014, the board of trustees of the Hawaii employer-union health benefits trust fund to require every health benefits plan established or contracted to include lower deductibles and co-payments for non-tobacco smokers and other persons of low risk. Requires the board to consult with medical professionals to determine low risk behavior. Prohibits genetic factors and pre-existing conditions as being considered a behavior. Effective July 1, 2012.

RELATING TO THE HAWAII EMPLOYER‑UNION HEALTH BENEFITS TRUST FUND.

Eliminates medicare part B reimbursements for employee-beneficiaries and spouses of employee-beneficiaries hired after June 30, 2012. Effective July 1, 2012.
