Status

RELATING TO MEDICAL ENTERPRISE ZONES.

Establishes medical enterprise zones in the State to encourage the development of medical and research services.  Establishes a qualified income tax credit of twenty-five percent for three years.  Creates a seven‑year pilot medical enterprise zone in West Maui.  Effective January 1, 2050.  Repealed January 1, 2053.  (HB116 HD1)

Status

RELATING TO EMPLOYMENT SECURITY.

Authorizes certain private employers to administer a work-sharing plan to avoid temporary layoffs, if approved by the Department of Labor and Industrial Relations.  Allows employees under a work-sharing plan to receive unemployment benefits to compensate for lost wages.  Requires employees to be employed for not less than 90 days to be eligible for participation in a work-sharing program.  Requires an employer to notify employees eligible to participate in a work-sharing program that unemployment compensation benefits may be affected if an employee becomes unemployed in the future. Effective September 1, 2013.  (HB2025 HD1)

Status

RELATING TO APPEALS TO THE APPELLATE BOARD.

Authorizes the Labor and Industrial Relations Appeals Board to establish reasonable fees not to exceed $30 for the filing of written appeals and to establish a Labor and Industrial Relations Appeals Board Special Fund.  Allows fees to be adjusted by the Director of Labor and Industrial Relations through rules.  Provides for fees to be waived in certain cases.  Requires the State and counties to pay filing fees.  (HB2582 HD1)

RELATING TO PROCUREMENT.

Requires the procurement policy board to adopt rules that include a five per cent preference for small businesses, a seven per cent preference for veteran-owned businesses, and a nine per cent preference for service-disabled veteran-owned businesses.  Effective July 1, 2030.  (HB2318 HD1)

RELATING TO STATE EQUIPMENT.

Requires state departments to attempt to sell or donate office equipment to schools, nonprofits, or salvage businesses before disposal.

RELATING TO TAXATION.

Changes the sunset date of the temporary suspension of the general excise tax exemptions for high technology research and development and for shipbuilding and ship repairs provided for in Act 105, Session Laws of Hawaii 2011.  Effective June 30, 2012.

RELATING TO LEASES.

Requires lessors of commercial and industrial property to afford lessees the option of renewing their leases.  Requires, in leasehold renegotiations, that a rent based on fair market value shall apply even if that value is lower than existing rent and the lease contract bars the lowering of rent upon renegotiation.

RELATING TO RECREATIONAL ACTIVITIES.

Repeals the statutory requirement that a trier of fact determine whether or not a risk is inherent to a recreational activity when determining whether a commercial provider of recreational activity is liable for a person's injuries.

RELATING TO INTOXICATING LIQUOR.

Amends section 281-78(b), HRS, to clarify that a licensee who timely suppresses unlawful activity, including by means of detaining and reporting an offender to the police, from occurring on the licensed premises shall not be in violation of that section.

Status

RELATING TO BUSINESS DEVELOPMENT IN HAWAII.

Amends the motion picture, digital media, and film production tax credits to increase the tax credits to unspecified percentages and dollar amounts and to provide additional non-refundable tax credits for qualified media infrastructure projects in certain qualifying counties; provides an additional tax credit for qualified special or visual effects and animation production costs; raises the tax credit caps to unspecified amounts.

RELATING TO ECONOMIC DEVELOPMENT.

Expresses as state policy an intent to complete or facilitate the completion of a list of 10 projects by 12/31/23.

Status

RELATING TO THE ECONOMY.

Extends the motion picture, digital media, and film production tax credit until 01/01/31 from 01/01/16.  Raises the qualified production credit ceiling to $10 million from $8 million.  Separates the calculation of the credit amount based on wages and salaries from the credit amount based on other qualified production costs.  Provides that the credit amount includes 15% of the wages and salaries paid to all cast, crew, and musicians of the qualified production, plus an additional 5% credit amount on wages and salaries of cast, crew, and musicians who are state residents.

Status

RELATING TO CREATIVE MEDIA DEVELOPMENT.

Amends section 235-17, Hawaii Revised Statutes, by expanding the definitions of qualified productions to include animation or special and visual effects and productions for internet distribution and providing the sunset date for the tax credit as amended by this Act as January 1, 2020.

If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes.  This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.

 

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
