SENATE RESOLUTION

 

 

CONVENING A Manoa Road Task Force to discuss ownership, maintenance, and repair responsibility of THE PORTION OF Manoa Road leading up to the Lyon Arboretum.

 

 

 


     WHEREAS, the University of Hawaii Lyon Arboretum and Botanical Garden is the only university botanical garden located in a tropical rainforest in the United States, as well as the only easily accessible tropical rainforest on the island of Oahu; and

 

     WHEREAS, the arboretum consists of almost two hundred acres at the top of the Manoa watershed with a set of small cottages and greenhouses used for research and community education about plants and the natural environments of Hawaii; and

 

     WHEREAS, the arboretum hosts approximately thirty-four thousand visitors each year who participate in classes, research projects, or other community activities or simply explore the grounds to enjoy the beautiful displays; and

 

     WHEREAS, several community organizations use the arboretum as their base of operations, including Hui Hana, Garden Club of Honolulu, and the Arboretum Association; and

 

     WHEREAS, Manoa Road is the only road that provides access to the arboretum; and

 

     WHEREAS, it is unclear which entity owns the portion of Manoa Road leading to the entry to Lyon Arboretum and, therefore, which entity is responsible for road maintenance and repair; and

 

     WHEREAS, the most efficient and effective way to determine which entity is responsible for that portion of Manoa Road is to convene a task force of stakeholders to reach consensus on the issue; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2012, that the Chairperson of the Board of Land and Natural Resources is requested to convene a Manoa Road Task Force to examine and make a recommendation to resolve the ownership, maintenance, and repair responsibility of the portion of Manoa Road leading up to the Lyon Arboretum; and

 

     BE IT FURTHER RESOLVED it is requested that the following members or their designees serve on the task force:

 

     (1)  The Chairperson of the Board of Land and Natural Resources, who is requested to serve as chairperson of the task force;

 

     (2)  The President of the University of Hawaii;

 

     (3)  Director of Transportation;

 

     (4)  Director of Transportation Services of the City and County of Honolulu;

 

     (5)  State legislators from the Senate and the House of Representatives who represent the area that includes Lyon Arboretum;

 

     (6)  The Honolulu City Council member who represents the Fifth District of the City Council;

 

     (7)  Chairperson of the Board of Paradise Park, Inc.; and

 

     (8)  A resident who resides in close proximity to the Lyon Arboretum, to be appointed by the Honolulu City Council member who represents the Fifth District of the City Council; and

 

     BE IT FURTHER RESOLVED that the task force is requested to report its findings and recommendations, including proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2013; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources; President of the University of Hawaii; Chairperson of the Board of Regents of the University of Hawaii; Director of Transportation; Director of Transportation Services of the City and County of Honolulu; President of the Senate; Speaker of the House of Representatives; Chairperson of the Honolulu City Council; and the Chairperson of the Board of Paradise Park, Inc.
