THE SENATE

S.B. NO.

2968

TWENTY-SIXTH LEGISLATURE, 2012

S.D. 2

STATE OF HAWAII

A BILL FOR AN ACT

RELATING TO MOTOR VEHICLE INSURANCE.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.  The legislature finds that many states allow insurers to offer motor vehicle insurance discounts to drivers who complete a driver safety course or driver improvement course in the classroom or online.  However, existing law in Hawaii on discriminatory practices in underwriting is silent on allowing motor vehicle insurance companies to offer discounts of any kind.

The purpose of this Act is to allow motor vehicle insurance companies to offer discounts on premiums if the insured completes a driver safety or driver improvement course.

SECTION 2.  Chapter 431, article 10C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§431:10C-    Driver safety or driver improvement course; premium discounts.  An insurer may offer premium discounts for insureds who complete a driver safety course or driver improvement course."

SECTION 3.  New statutory material is underscored.

SECTION 4.  This Act shall take effect upon its approval.
