A BILL FOR AN ACT

 

 

RELATING TO MEDICAID.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-     Medical assistance re-enrollment.  (a)  Beginning January 1, 2014, and every year thereafter, the department shall require all eligible recipients of medical assistance under any medicaid program administered by the department, including any medicaid waiver program, to re-enroll in such medicaid program every year by the anniversary date of the recipient's enrollment or other such date as the department determines to be appropriate.  As part of the re-enrollment process, the recipient shall state on an official form developed by the department that the recipient continues to meet the appropriate program eligibility requirements.

     (b)  The parent or legal guardian of a minor receiving medical assistance under any medicaid program administered by the department, including any medicaid waiver program, shall be responsible for fulfilling the requirements of subsection (a) on behalf of the minor recipient.

     (c)  Beginning January 1, 2014, any process or program providing for the automatic re-enrollment of any recipient of medical assistance under any medicaid program administered by the department shall no longer be effective.

     (d)  The department shall adopt or amend rules pursuant to chapter 91 to effectuate the purposes of this section, including any necessary forms and procedures."

PART II

     SECTION 2.  The president of the senate and the speaker of the house of representatives shall establish a joint legislative task force on medicaid to examine issues relating to medicaid.  The chair of the committee having jurisdiction over medicaid of the respective houses of the legislature shall co-chair the task force.  Members of the committee of the respective houses of the legislature shall be members of the task force.  The task force shall also comprise of the following members:

     (1)  The director of human services, or the director's designee;

     (2)  Representatives from each health care plan contracted with the State under the medicaid program;

     (3)  Representatives from the provider community, including the Hawaii Medical Association; and

     (4)  Representatives from the hospital community, including the Healthcare Association of Hawaii.

     The task force may conduct meetings, briefings, and hearings, as appropriate, and recommend legislation pursuant thereto. 

PART III

     SECTION 3.  Chapter 346D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346D-    Community-base facility; commensurate medicaid reimbursement.  For the purpose of reimbursement, all medicaid beneficiaries categorized in the same or equivalent level of care, living in a community-based facility, whether a licensed community care foster family home or licensed adult residential care home and for reason of reimbursement parity, shall receive a commensurate amount of reimbursement for board and lodging and food and services."

PART IV

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2050.
