A BILL FOR AN ACT

 

 

relating to charter schools.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302B-    Extracurricular activities.  (a)  Notwithstanding any other law to the contrary, the department shall provide students at charter schools with the same opportunity to participate in extracurricular activities that is provided to students at other public schools.

     (b)  If a student at a charter school wishes to participate in an extracurricular activity for which there is no program at the charter school, the department shall allow that student to participate in a comparable program in a public school located near the student's residence; provided that the department may deny the student's request to participate in the extracurricular activity if the school providing the activity has a reasonable basis for the denial, including a lack of funds, or if the student's participation would violate any rule relating to the activity.

     A student who is denied permission to participate in an extracurricular activity because of a lack of funds shall be allowed to participate in the activity if the student or charter school pays the costs of the student's participation in the activity."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
