A BILL FOR AN ACT

 

 

RELATING TO MEDICAID.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-     Medicaid prescription drug benefits; copayment.  (a)  Medicaid recipients for whom medicaid is the primary insurer shall be required to pay a copayment for prescription drugs covered under the recipient's medicaid benefits in accordance with a program established by the department; provided that a copayment shall not be required for prescription drugs for recipients under nineteen years of age, terminally ill recipients receiving hospice care, recipients residing in nursing homes or in home- or community-based settings that provide a certified intermediate care facility or skilled nursing facility level of care, or recipients who are pregnant.

     (b)  The department shall adopt rules in accordance with chapter 91 to establish and implement a medicaid prescription drug benefit copayment program.  The copayment amounts shall be equal to the lowest tier amounts under the Medicare Part D low-income subsidy."

     SECTION 2.  Prior to the establishment and implementation of the medicaid prescription drug benefit copayment program required under section 346-   , Hawaii Revised Statutes, the department of human services shall seek the approval of the Centers for Medicare and Medicaid Services for the program.  Implementation of the medicaid prescription drug benefit copayment program shall be subject to such approval.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.

Description:

Requires certain Medicaid recipients to pay a copayment for prescription drugs covered under the recipients' Medicaid benefits in accordance with a program developed by the Department of Human Services.  Requires the Department of Human Services to seek the approval of the Centers for Medicare and Medicaid Services prior to the establishment and implementation of the program.
