A BILL FOR AN ACT

 

 

RELATING TO HISTORIC PRESERVATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§6E-     Sale or lease of undeveloped property.  (a)  Prior to the sale or lease of any length of term of undeveloped property, or prior to advertising such sale or lease, the owner of the property or person responsible for the sale or lease of the property shall cause to be performed an archaeological inventory survey of the undeveloped property.  The archaeological inventory survey shall be submitted to the division for review and approval.  Following approval of an archaeological inventory survey by the division, appropriate mitigation plans for preservation and data recovery shall also be submitted to the division for review and approval.  If burials are identified during the archaeological inventory survey:

     (1)  Sections 6E-43 and 6E-43.5; and

     (2)  Chapter 13-300, Hawaii Administrative Rules,

shall determine appropriate treatment and mitigation measures.  Any sites or resources found on the property that may be eligible for the Hawaii registry of historic places shall be noted on a plan, prepared and filed with the bureau of conveyances in accordance with section 502-17.

     (b)  For the purposes of this section:

     "Division" means the state historic preservation division.

     "Undeveloped property" means property situated in the State that is:

     (1)  Unimproved real property; or

     (2)  Real property upon which there is infrastructure or improvements that will be demolished and removed."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
