A BILL FOR AN ACT

 

 

RELATING TO PUBLIC HOUSING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§356D-     Time limitation on tenancy.  (a)  There shall be a five-year time limit for any tenant's use and occupation of a dwelling unit or other premises located within a state public housing project; provided that this section shall not apply to a tenant who is elderly or who is disabled.

     (b)  The authority shall adopt rules pursuant to chapter 91 to implement this section.

     (c)  For purposes of this section, "elderly" means a person who is sixty-five years of age or older."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Requires the Hawaii Public Housing Authority to adopt rules to implement a five-year time limit for a tenant's use and occupation of any dwelling unit or other premises located within a state public housing project.  Exempts tenants who are elderly or disabled.  (HB1796 HD1)
