A BILL FOR AN ACT

 

 

RELATING TO ENERGY EFFICIENCY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that televisions account for the fastest growing source of residential energy use in the State.  Hawaii is particularly vulnerable in its dependence on imported energy.  Therefore, the legislature has a special interest in ensuring energy conservation and efficiency to secure the future well-being of the State and its people.  As part of this policy, the State enacted Act 73, Session Laws of Hawaii 2010, which established the Hawaii clean energy initiative program to ensure the State's energy security.

     In accordance with the goals of the clean energy initiative, the purpose of this Act is to reduce and limit the amount of energy consumed by televisions in the State.

     SECTION 2.  Chapter 196, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part      .  television energy efficiency standards

     §196-     Definitions.  As used in this part, unless the context otherwise requires:

     "Combination television" means a system in which a television or television monitor and an additional device or devices, including a digital video disc player or video cassette recorder, are combined into a single unit in which the additional devices are included in the television casing.

     "Component television" means a television composed of two or more separate components (e.g., separate display device and tuner) marketed and sold as a television under one model or system designation, which may have more than one power cord.

     "ENERGY STAR" means a labeling program administered jointly by the United States Environmental Protection Agency and the United States Department of Energy to identify and promote energy-efficient products.

     "Motor vehicle" means the same as defined in section 286-2.

     "Television" means any analog or digital device primarily designed for the display and reception of a terrestrial, satellite, cable, internet protocol television, or other broadcast or recorded transmission of analog or digital video and audio signals, including combination televisions, television monitors, component televisions, and any unit that is marketed or sold to a consumer as a television.  "Television" does not include computer monitors.

     "Viewable screen area" means the continuous total area of a television screen in square inches that displays a digital or analog video signal and that is viewable to a consumer.

          §196-     Scope and application.  (a)  This part shall apply to all new televisions manufactured after June 30, 2012, that are offered for sale or installed in the State as stand-alone products or as components of other products.

     (b)  This part shall not apply to televisions:

     (1)  Manufactured in the State and sold outside the State;

     (2)  Manufactured outside the State and sold at wholesale inside the State for final retail sale and installation outside the State; or

     (3)  Designed expressly for installation and use in motor vehicles.

     §196-     Television efficiency standards.  No new television with a viewable screen area of one thousand four hundred square inches or less manufactured after June 30, 2012, may be sold, offered for sale, or installed in the State unless its energy efficiency standards meet or exceed the ENERGY STAR specifications in effect at the time of the sale."

     SECTION 3.  If any provision of this Act, or the application thereof to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of the Act, which can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.

     SECTION 4.  This Act shall take effect upon approval.
