A BILL FOR AN ACT

 

 

relating to schools.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§302A-     Schools designated for consolidation; tuition.  (a)  Any school that has been designated by the board to be closed for the purpose of consolidation, pursuant to section 302A-1129, shall be allowed to continue operations if:

     (1)  The board determines that the imposition of tuition at the school would produce revenue at least equal to the amount in cost savings that would be realized through consolidation; and

     (2)  Tuition as contemplated under paragraph (1) is imposed at the school.

     (b)  The board shall adopt rules under chapter 91:

     (1)  Specifying the criteria and procedure for schools to continue operations under this section;

     (2)  Establishing a method to determine the amount of tuition to be imposed and the manner of implementing tuition; and

     (3)  Notwithstanding the requirements of section 302A-1145, providing for the transfer of any student from a school at which tuition is imposed under this section to another school, if a parent or guardian of the student elects not to pay tuition.

     (c)  For purposes of this section, "consolidation" means the closing of one or more existing schools and the transfer of all students enrolled at the closed school to another school and does not include the mere transfer of one or more grade levels to another school."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
