HOUSE CONCURRENT

RESOLUTION

 

 

affirming the intent of the legislature that amendments to the state health services and facilities plan be done through the public hearings process.

 

 

 


     WHEREAS, the Legislature established the State Health Planning and Development Agency and the Statewide Health Coordinating Council and mandated them to both prepare and amend the State Health Services and Facilities Plan; and

 

     WHEREAS, the Legislature mandated that the State Health Services and Facilities Plan address the health care needs of the State, including inpatient care, health care facilities, and special needs;

 

     WHEREAS, the Legislature mandated that the preparation of and amendments to the State Health Services and Facilities Plan be done through the public hearings process, including public notice and the opportunity to be heard; and

 

     WHEREAS, the Legislature mandated that the decisions of the State Health Planning and Development Agency on whether to issue a certificate of need to a health care facility for capital improvements be consistent with the State Health Services and Facilities Plan and, if requested by the health care facility, also be done through the public hearings process; and

 

     WHEREAS, a denial of a certificate of need may prevent a health care facility from receiving reimbursements for Medicare and Medicaid; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the Senate concurring, that the Legislature affirms that amendments made by the State Health Planning and Development Agency to the State Health Services and Facilities Plan are intended to be done through the public hearings process; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, the Director of Health, the Administrator of the State Health Planning and Development Agency, the Chairperson of the Statewide Health Coordinating Council, the Chairperson of each of the several subarea health planning councils, and the Mayor of each county.
