A BILL FOR AN ACT

 

 

Relating to rental agreements.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 521-43, Hawaii Revised Statutes, is amended by amending subsection (h) to read as follows:

     "(h) [Landlords] In the case of a written or oral rental agreement, every landlord shall provide [their] the landlord's current general excise tax number in writing to all tenants [for the purpose of filing for a low-income tax credit].  All payments or deposits to a landlord from a tenant shall be made by personal check, certified or cashier's check, bank or postal money orders, traveler's check, or other written instrument or order for the transmission or payment of money, which shall list the current general excise tax number as provided by the landlord.  The landlord shall notify all tenants in writing within fourteen days if the landlord's general excise tax license number changes.  If a landlord fails to comply with this subsection, the written or oral rental agreement shall be unenforceable against the tenant."

     SECTION 2.  The department of commerce and consumer affairs shall include landlord obligations and tenant rights as contained in section 521-43, Hawaii Revised Statutes, in the department's landlord-tenant handbook and on the department website.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.   

     SECTION 4.  This Act shall take effect upon its approval.

Enforces the disclosure of every landlord's current general excise tax number to all tenants, and requires all payments from tenants to landlords to reference the landlord's current general excise tax number.  Informs tenants of their rights and resources in landlord-tenant matters.
