A BILL FOR AN ACT

 

 

relating to dangerous weapons.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 134, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§134-    Explosive devices; prohibitions; penalty.  (a)  It shall be unlawful for any person to construct, set off, ignite, discharge, or otherwise cause to explode any homemade explosive device.

     (b)  Whoever knowingly or intentionally constructs, sets off, ignites, discharges, or otherwise causes to explode any homemade explosive device shall be guilty of a class C felony.

     (c)  For the purposes of this section, "homemade explosive device" means a non-commercially manufactured device composed of a single ingredient, or mixture of ingredients, capable of instantaneously releasing a sufficient amount of energy to inflict substantial damage to persons or property."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
