RELATING TO TAXATION.

Returns $200,000,000 from the funds generated by surcharge on state general excise tax revenues transferred to the city and county of Honolulu to the State general fund.  Authorizes issuance of $300,000,000 GO bonds to offset loss of tax revenues to the city and county of Honolulu in fiscal year 2010-2011.  Extends surcharge for two years.

RELATING TO ADMINISTRATIVE LICENSE REVOCATION.

Permits driver whose license has been administratively revoked for life to seek reinstatement of the license after 10 years have passed since the occurrence of the lifetime revocation.  Requires driver to have had no arrests or convictions for driving while license revoked and to be free from dependency or abuse of alcohol and drugs.  Effective 7/1/11.

RELATING TO COMMERCIAL DRIVER LICENSING.

Conform sections 286-240(g) and (h), HRS to the federal commercial driver licensing law to meet the requirements of 49 CFR Section 383.51(e) before September 4, 2010, as required by Safe, Accountable, Flexible, Efficient Transportation Equity Act:  A Legacy for Users (SAFETEA-LU).

RELATING TO HIGHWAY SAFETY.

Create a new law for distracted driving for drivers who operate any mobile electronic devices while operating a motor vehicle on the highways within the State of Hawaii to further define the penalties for reckless drivers will be a deterrent and result in safer roadways.

RELATING TO COMMERCIAL DRIVER LICENSING.

Extend the term of a commercial driver's license (CDL) for persons 21 years through 71 years from six years to eight years to prepare for the REAL ID Act, which is a nationwide effort to improve the integrity and security of state-issued driver licenses and identification cards, to help fight terrorism and reduce fraud.  Appropriate $8,000 out of the state highway fund.

RELATING TO DRIVER LICENSING.

Differentiate category four motor vehicles from commercial motor vehicles to clarify that category four motor vehicles do not include commercial motor vehicles as defined in section 286-2, HRS.

RELATING TO HYBRID BICYCLES.

Clarifies the definition of bicycle to include electric motor bicycles for purposes of county vehicular taxes and the statewide traffic code.  Specifies type of bicycles to be allowed to be transported on public busses.

Please note:  If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally.  A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
