Madam:

 

     Your Committee on Judiciary and Government Operations, to which was referred S.B. No. 2775, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO PUBLICITY RIGHTS NAMES AS DISTINGUISHED FROM TRADE NAMES AND SPECIFYING REGISTRATION PROCEDURES FOR PUBLICITY RIGHTS NAMES BY AMENDING CHAPTER 482P,"

 

begs leave to report as follows:

 

     The purpose of this measure is to clarify provisions related to publicity rights by:

 

     (1)  Renaming "publicity rights trade name registration" as "publicity rights name registration" under chapter 482P, Hawaii Revised Statutes; and

 

     (2)  Giving the Department of Commerce and Consumer Affairs discretion to implement the law in a manner that complies with the law's legislative intent.

 

     Your Committee finds that this measure will prevent confusion for those registering publicity rights names by separating this registration from traditional trade name registration.  In addition, the measure clarifies that the Department of Commerce and Consumer Affairs' role is purely ministerial and provides discretion to the Director of Commerce and Consumer Affairs in implementing the registration procedures.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary and Government Operations that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2775, S.D. 1, and recommends that it pass Third Reading.
