A BILL FOR AN ACT

 

 

RELATING TO THE HAWAIIAN LANGUAGE COLLEGE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaiian language college at the University of Hawaii at Hilo, the department of education, and the charter school administrative office shall enter into an agreement regarding the Hawaiian language college's functions related to Nawahiokalaniopuu school and other schools, as appropriate, as laboratory schools, under section 304A-1302(2), Hawaii Revised Statutes.  The agreement shall include, but not be limited to, the following provisions:

     (1)  The department of education and the charter school administrative office shall provide to the Hawaiian language college all written department of education and charter school organizational, operational, and management materials and communications, as applicable to Nawahiokalaniopuu school and other laboratory schools, as appropriate;

     (2)  The Hawaiian language college, through the medium of the Hawaiian language, shall translate and modify, as appropriate to meet the unique needs of the Hawaiian language and cultural curricula, the written materials and communications for the use of Nawahiokalaniopuu school and other laboratory schools; provided that the Hawaiian language college shall maintain consistency with applicable state or federal laws;

     (3)  The department of education and the charter school administrative office shall consult with the Hawaiian language college in determining which service functions are best provided by the Hawaiian language college, rather than the standard entities of the department of education and the charter school administrative office, and reach agreement that the Hawaiian language college shall provide specific functions through the Hawaiian language, such as in-service training in literacy development when Hawaiian literacy development requires different strategies;

     (4)  The department of education and the Hawaiian language college may determine other public education functions of the charter school administration office and the department of education, including those under chapter 302H, Hawaii Revised Statutes, which the Hawaiian language college may conduct for the charter school administration office and the department of education and reach an agreement regarding the functions;

     (5)  The Hawaiian language college, the department of education, and the charter school administrative office shall review annually:

         (A)  All activities implemented under the agreement;

         (B)  The success of implementation and any issues or problems to be resolved;

         (C)  Any recommendations for changes in the agreement; and

         (D)  How implementation under the agreement contributes to the provision of Hawaiian language medium education, pursuant to chapter 302H, Hawaii Revised Statutes;

     (6)  The Hawaiian language college may use its own funds, funds from external sources, special legislative appropriations, or funds that the charter school administrative office or department of education may transfer to the Hawaiian language college for the functions described in this Act;

     (7)  The agreement shall be required to cover only those programs and entities known by the broad name Nawahiokalaniopuu school, with other laboratory schools to be included at the joint request of those schools and the Hawaiian language college; and

     (8)  The agreement shall continue for five years, unless it is replaced with another agreement or terminated by mutual agreement of the three parties.

     SECTION 2.  This Act shall take effect on July 1, 2050.
