establishing a task force to draft recommendations on reasonable restrictions on flying the united states and state flag within Planned community associations and condominiums.




     WHEREAS, a flag is one of the most widely employed and recognizable symbols used to represent a nation, entity, or organization; and


     WHEREAS, the Flag of the United States of America, or American Flag, is one such symbol that represents the ideals that were used to establish this country, including those of life, liberty, equality, and the pursuit of happiness; and


     WHEREAS, the American Flag is frequently displayed, not only on public buildings, but on private residences, and is also used as a motif on decals for car windows and on clothing ornaments such as badges and lapel pins; and


     WHEREAS, the display of, and respect for, the American Flag as a symbol of the United States of America holds such importance that guidelines for the use, display, and disposal of the flag are codified in various Titles of the United States Code, including Title 4, Title 18, and Title 36; and


     WHEREAS, respect and display protocols exist for numerous flags around the world, including state flags and international flags; and


     WHEREAS, community associations are often charged with duties that include developing rules and regulations to preserve the aesthetic conditions of the entire community, which at times may involve establishing restrictions on the display of flags in the community; and


     WHEREAS, these restrictions have resulted in emotional situations to which compromises need to be found that preserve the aesthetic quality of a planned community while allowing for the reasonable display of flags; now, therefore,


     BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, that there is hereby established a task force (Task Force), to be placed within the State Department of Defense for administrative purposes only, to draft recommendations on reasonable restrictions and protocols for the respectful display of the United States and State flag by homeowners belonging to a planned community association and condominium association; and


     BE IT FURTHER RESOLVED that this Task Force shall be composed of members representing the State Department of Defense or the Veterans' Administration, various veterans organizations, community associations, and homeowners belonging to community associations; and


     BE IT FURTHER RESOLVED that the Adjutant General of the State of Hawaii, or the Veterans' Administration, shall serve as chair of the Task Force, shall select the members of the Task Force, and shall report the findings and recommendations of the Task Force, including any proposed legislation, to the Legislature no later than 20 days prior to the convening of the Regular Session of 2012; and


     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Adjutant General, State Department of Defense, and the Veterans' Administration.
