RELATING TO TRANSPORTATION.

Allows for the operation of larger articulated buses used for public transit purposes on public roadways.

RELATING TO HIGHWAYS.

Requires the Department of Transportation (DOT) to conduct more frequent reviews of the condition of highway guardrails on the island of Hawaii that are deteriorating from exposure to acid rain caused by vog.  Requires DOT to research measures and technology that could be used to prevent guardrail deterioration.

RELATING TO HIGHWAY SAFETY.

Modifies the current reckless driving law to include defined penalties for first-time offenders and repeat offenders guilty of one or more traffic violations under the State's Traffic Code.

RELATING TO PUBLIC ROADS.

Allows any person to file for a contested case hearing to determine jurisdiction over a public road and establishes the determination process.

RELATING TO COUNTY HIGHWAY PATROLS.

Allows counties to establish highway patrols as part of police departments; requires uncontested traffic fines and forfeitures to be transmitted to the counties for highway patrols.

RELATING TO DISPOSITION OF CRIMINAL OFFENDERS.

Permits person convicted of habitual operation of a vehicle under the influence of an intoxicant to be released under supervision, after completion of mandatory minimum term of imprisonment on conditions that include use of a transdermal alcohol monitoring device at the defendant's own expense.

Status

RELATING TO IMPOUNDMENT OF VEHICLES.

Authorizes and sets forth procedures for impounding a motor vehicle after a person has been fined three or more times for operating a vehicle without a valid certificate of inspection, or for operating a vehicle without being duly licensed, without a valid insurance card, or without a valid insurance policy.

RELATING TO HIGHWAY SAFETY.

Requires all noncommercial vehicles to undergo a vehicle safety inspection every 2 years.  Directs the department of transportation to increase inspection fees to double the current rate.

RELATING TO MOPEDS.

Requires mopeds to have license plates, similar to motorcycles, as opposed to tags.  Treats mopeds like motor vehicles instead of bicycles for registration purposes.

RELATING TO MOTOR VEHICLES.

Authorizes motor vehicle towing companies to add the general excise tax to the fees charged to the owner of a motor vehicle left unattended on private or public property.

RELATING TO REGULATION.

Establishes a transportation carrier commission to regulate water and motor carriers.  Removes such carriers from the jurisdiction of the public utilities commission.

RELATING TO AIRPORTS.

To provide statutory authority to allow the Department of Transportation to adopt rules that require certain private persons who use the State's commercial airports, to defend, hold harmless and indemnify the State and any of its agencies, officers, and employees, against all claims that arise from such use.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

·     Testifier's name with position/title and organization;

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
