RELATING TO NATUROPATHIC MEDICINE.

Amends the title of the chapter regulating naturopathy to "naturopathic medicine"; defines "naturopathic medicine"; authorizes naturopathic physicians to administer parenteral therapy; authorizes naturopathic physicians to obtain Federal Drug Enforcement Administration registration; authorizes temporary license to licensed out-of-state naturopathic physicians in a declared public health emergency.

Protects the confidentiality of prescription records identifying a doctor or other health care professional licensed to prescribe medications by prohibiting the use of such information for marketing purposes.  Ensures that the State comply with federal restrictions on the transfer and use of medicaid data.

RELATING TO THE DISCLOSURE OF VITAL STATISTICS RECORDS TO LAW ENFORCEMENT OFFICERS.

Authorizes the Department of Health to provide certain public health records to law enforcement officers to facilitate criminal investigations.

RELATING TO SAFE PATIENT HANDLING PROTOCOL.

Requires each private hospital in the State and each community hospital within the Hawaii health systems corporation to establish a safe patient handling committee by 01/01/2010 and a safe patient handling program by 10/01/2010.

RELATING TO DEPARTMENT OF HEALTH CERTIFICATES.

Repeals the requirement for a sanitation certificate to be issued for county business licenses for the operation of a lodging or tenement house, group home, group residence, group living arrangement, hotel, or boarding house.  The City and County of Honolulu no longer requires business licenses for these facilities because of Act 35, Session Laws of Hawaii 2001, so the sanitation certificate is unnecessary for Oahu.  The counties of Kauai, Maui, and Hawaii never required a sanitation certificate for these types of businesses.

Clarifies that the provisions of section 704-412, Hawaii Revised Statutes, govern the timing and standards of decision for applications for conditional release or discharge from the custody of the Director of Health and includes a time frame for decisions on motions for conditional release or discharge.

Allows nurse practitioners, clinical nurse specialists, certified nurse midwives, and physician assistants, who provide the actual care, to sign certain medical certification forms for their patients applicable to the care provided within each practitioner's scope of practice.

Removes, for an unlicensed foreign nursing school graduate applying for a registered nurse license in Hawaii, the requirement for a school transcript to be evaluated.  Requires board of nursing to adopt rules requiring submission of the breakdown of educational program for international nursing programs form.

Establishes a veterans' gift account to be administered by the Hawaii health systems corporation.  Also requires account to comply with reporting requirements for non-general fund information.

Creates a process for a patient to direct end-of-life treatment in a standardized physician orders for life sustaining form.  Requires department of health to design the form.  Requires department of health and Hawaii health systems corporation to require adoption of the form in their respective health facilities.

RELATING TO INFECTIOUS DISEASE TESTING.

Proposes to expand routine HIV testing by health care providers to improve early diagnosis of HIV by removing the requirement for health care providers to obtain written informed consent and to provide pre-test counseling prior to testing for HIV.

Requires hospitals to provide information about emergency contraception to women who are sexually assaulted and to provide emergency contraception when requested.  Provides for administrative penalties for noncompliance.
