A BILL FOR AN ACT


 

 

relating to makapipi stream, maui.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Makapipi stream, located in the Nahiku district of Maui, is a perennial stream that runs from the east Maui mountains to the sea and provides a majestic view of a waterfall just as it passes under the famed Hana highway.

     The purpose of this Act is to direct the department of land and natural resources to undertake a study to ensure that Makapipi stream is and remains sufficiently protected in the public interest.

     SECTION 2.  The department of land and natural resources is directed to undertake a study of Makapipi stream, located in the district of Nahiku on Maui, to determine whether the stream is sufficiently protected in the public interest.  As part of its study, the department of land and natural resources shall:

     (1)  Conduct an investigation and collect instream flow and other data, including fishing, wildlife, aesthetic, recreational, water quality, water flow and seasonal changes in flow, other ecological information, and basic streamflow characteristics;

     (2)  Determine the extent and quantity of any diversions of water from the stream;

     (3)  Investigate threatened or endangered beneficial instream uses of water;

     (4)  Determine the amount and causes of debris, whether naturally or humanly caused, found in the stream, and whether the debris is detrimental to the streamflow;

     (5)  Determine whether there should be adopted an instream flow standard for the stream; and

     (6)  Recommend any other measures that need to be undertaken to ensure the stream is protected in the public interest.

     SECTION 3.  The department of land and natural resources is directed to submit its findings, including any recommended legislation, to the legislature at least twenty days prior to the convening of the regular session of 2010.

     SECTION 4.  This Act shall take effect upon its approval.
