Madam:

 

     Your Committees on Transportation and International Affairs and Intergovernmental and Military Affairs, to which was referred H.B. No. 509, H.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"

 

beg leave to report as follows:

 

     The purpose of this measure is to prohibit a towing company from charging the owner of a vehicle targeted for towing if the owner of the vehicle appears on the scene.

 

     Testimony in support of this measure was received from the Department of Commerce and Consumer Affairs, Waialae Towing, and D&H Towing.

 

     Your Committees have heard and approved a comparable measure, H.B. No. 2954, S.D. 1, which incorporates the language in this measure.

 

     Therefore, your Committees have amended this measure by deleting its content and replacing it with new language to:

 

     (1)  Amend chapter 261, Hawaii Revised Statutes, to establish a Rental Motor Vehicle Customer Facility Charge Special Fund (Fund) for the enhancement, renovation, operation, and maintenance of existing rental motor vehicle customer facilities and the development of new rental motor vehicle customer facilities at state airports;

 

     (2)  Amend section 261-7, Hawaii Revised Statutes, to authorize the Department of Transportation to establish and collect a monthly rental motor vehicle customer facility charge for deposit in the Fund;

 

     (3)  Amend other sections of Hawaii Revised Statutes, as appropriate, to reference the new Fund;

 

     (4)  Authorize the Department of Transportation, as of September 1, 2008, to collect a $1 daily charge on rentals at state airports, until the sum of $25,000,000 is collected and deposited in the Fund;

 

     (5)  Appropriate out of the Fund the sum of $7,000,000 for:

 

          (A)  Planning and design of rental motor vehicle customer facilities at state airports; and

 

          (B)  Improvement, pavement, construction, and fencing to an existing ground-level storage area shared by rental motor vehicle concessions at the state airport located in Kahului, Maui; and

 

     (6)  Provide an effective date of July 1, 2008.

 

     As affirmed by the records of votes of the members of your Committees on Transportation and International Affairs and Intergovernmental and Military Affairs that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 509, H.D. 2, as amended herein, and recommend that it pass Second Reading in the form attached hereto as H.B. No. 509, H.D. 2, S.D. 1, and be referred to the Committee on Ways and Means.
